These Terms govern the use of the ever2 app and online service.

These Terms apply to the use of the ever2 app and online service.

2. Purpose of ever2
ever2 provides couples and, where relevant features are used, additional connected people with questions, games, conversation prompts and shared communication features. The current scope is described in the Apple App Store and in the app.
ever2 supports personal conversations and mutual understanding. It is not a medical, psychological or therapeutic service and does not replace couples therapy, psychological advice or medical treatment.
3. Eligibility
Registration and use are permitted only for people aged 18 or over. A personal account is required. Registration information must be complete and accurate. Accounts may not be transferred or made available to third parties without our consent.
4. Registration and contract
The user contract is formed when the required registration information has been entered, these Terms have been accepted, the Privacy Policy has been acknowledged and registration by email or Sign in with Apple has been completed successfully.
There is no entitlement to registration or account activation. The Privacy Policy is separate from these Terms.
5. Account security
Users must keep login credentials confidential and protect them against third-party access. Suspected unauthorized account use must be reported to AGIBO without delay. Liability applies only within the limits of applicable law.
6. Connecting with others
Certain features require users to connect using an invitation code. Codes may only be shared with their intended recipients. Once connected, certain profile information, answers, results and messages may be visible to connected people. Users should check who is connected before submitting personal or intimate content. Couple or three-person connections can be ended using the relevant feature.
7. User content
Users retain their rights in answers, messages, profile pictures and other submitted content. Content must not violate law or third-party rights; be abusive, threatening or discriminatory; promote violence or abuse; disclose unrelated third-party data without authority; contain malware, advertising or spam; or infringe intellectual property.
Users grant AGIBO the non-exclusive permission technically required to store and transmit their content and display it to their connected people within ever2, solely to provide the app features.
8. Misuse
Where there are concrete indications of a violation, we may temporarily block or remove affected content and reasonably restrict accounts. Before permanent suspension, the affected person will generally be informed and given an opportunity to respond unless legal requirements, security interests or the seriousness of the violation prevent this. Termination for good cause remains unaffected.
9. Availability and changes
We aim to provide ever2 reliably but cannot guarantee uninterrupted or error-free availability. Temporary limitations may result from maintenance, security measures, technical faults or circumstances beyond our control. Required updates and changes are provided under applicable law; material adverse changes will be communicated in good time.
11. Rights in ever2
The app, design, question catalogues, graphics, marks, texts and other AGIBO content are protected. They may be used only personally and non-commercially within ever2. Reproduction, publication, resale or automated analysis is prohibited unless permitted by law or expressly authorized.
12. Warranty and liability
Statutory warranty rights apply. AGIBO has unlimited liability for intent and gross negligence; injury to life, body or health; product liability; and expressly assumed guarantees. For slight negligence involving essential contractual duties, liability is limited to damage typically foreseeable when the contract was made. Other liability for slight negligence is excluded where legally permitted. This also applies to AGIBO’s representatives and agents.
13. Term, termination and account deletion
The user contract runs indefinitely. Users may end it at any time by deleting their account in the app. Account data is deleted under the Privacy Policy unless legal retention duties or other justified grounds require limited continued storage.
Deleting the account does not cancel an active App Store subscription; it must also be cancelled through the Apple account. AGIBO may terminate with reasonable notice, while termination for good cause remains unaffected.
14. Changes to these Terms
Changes will be communicated in good time in text form or within the app. Where renewed consent is required, ever2 may be used only after consent to the new version. Silence does not constitute acceptance unless permitted by law.
15. Consumer dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
16. Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice does not remove mandatory protections of the country of habitual residence.
